Your Rights Do Not Depend on Your Immigration Status

California labor and civil rights laws protect every employee, regardless of immigration status. Threatening to call immigration on an employee who complained is itself unlawful retaliation under Labor Code 244, and see also 1019.

Who Employs Fresno, and Where Do Violations Cluster?

Agriculture. Central Valley growers and farm labor contractors in table grapes, almonds, and stone fruit. Piece rate games, unpaid rest and recovery time, and heat rule retaliation.

Food processing and packing. Line speed pressure, meal break violations, and seasonal layoff games.

Healthcare. The large regional systems, with SB 525 wage floors and nurse breaks.

Warehousing. The Valley distribution expansion, where the AB 701 quota rules apply too. See warehouse and logistics.

Do Farmworkers Get Overtime Now?

Yes. Under AB 1066 the phase in is complete: agricultural workers earn overtime after 8 hours a day or 40 a week at every employer size, with double time rules.

On a 10 hour harvest day, hours 9 and 10 are overtime.

Piece rate employees must be paid separately for rest and recovery periods and nonproductive time under AB 1513.

What Is the Minimum Wage in Fresno?

No city ordinance, so the state floor controls: $16.90 in 2026, with fast food at $20.00 under AB 1228 and the SB 525 healthcare tiers.

Piece rate pay must still average at least minimum wage for every hour worked. See the deadline table.

What Does SB 294 Change for Fresno Employees In 2026?

The Workplace Know Your Rights Act requires employers to give every employee a written rights notice by February 1, regardless of immigration status, to let employees designate an emergency contact, and to notify that contact if an employee is arrested or detained at work.

It is a notice statute and a retaliation hook. A missing notice is itself a red flag worth telling us about.

Where Do Fresno Employment Cases Get Filed?

Fresno County Superior Court, B.F. Sisk Courthouse at 1130 O Street. Federal claims go to the Eastern District of California, Fresno courthouse at 2500 Tulare Street.

Agency paths: the California Civil Rights Department (CRD) for FEHA, the Labor Commissioner for wages, and the ALRB for union activity on farms as a distinct track. Fresno is one of the few markets with its own CRD office, at 1277 E Alluvial Avenue, Suite 101, Fresno 93720. The Labor Commissioner is at 770 E Shaw Avenue, Suite 222, Fresno 93710.
