Can a State Employee Sue for Wrongful Termination?

There is generally no Tameny public policy claim against a public entity, per Miklosy v. Regents.

The statutory routes that do work against public employers include FEHA discrimination and retaliation, since the State is a covered employer, Labor Code 1102.5 whistleblower claims, and Health and Safety Code 1278.5 for public hospital employees.

A key deadline: the Government Claims Act generally requires presenting a damages claim within six months of accrual before suing a public entity, with a carve out for claims under California’s Fair Employment and Housing Act (FEHA), the state’s main workplace discrimination law.

Civil service appeal rights through the State Personnel Board run as a parallel track with their own short deadlines, so act on all tracks at once.

Who Employs Sacramento, and Where Do Claims Cluster?

State agencies and the Capitol workforce. Discipline used as pretext, whistleblower retaliation after reporting misuse of funds, and promotion discrimination.

Healthcare. The major systems here include Sutter Health, UC Davis Health, Kaiser, and Dignity Health. The sector produces nurse break violations, SB 525 wage floor disputes, and 1278.5 whistleblower claims. Note that UC Davis Health staff are public entity employees, so the rules differ.

Private sector. Regional tech and logistics employers, where the full FEHA and Labor Code toolkit applies.

Does Sacramento Have Its Own Minimum Wage?

No city ordinance, so the state floor controls: $16.90 in 2026. Fast food is $20 under AB 1228, and the SB 525 healthcare tiers apply. See the deadline table.

Where Do Sacramento Employment Cases Get Filed?

Sacramento County Superior Court, Tani G. Cantil-Sakauye Courthouse at 500 G Street. Federal claims go to the Eastern District of California at 501 I Street.

Agency paths: the CRD for FEHA, the Labor Commissioner for wages, and the State Personnel Board for civil service discipline. The headquarters of the California Civil Rights Department (CRD), the state agency that handles discrimination complaints, is at 651 Bannon Street, Suite 200, Sacramento 95811, and the Labor Commissioner is at 2031 Howe Avenue, Suite 100, Sacramento 95825.
