Leave of absence
California Pregnancy Disability Leave Lawyers
PDL gives up to four months of job protected leave. CFRA bonding leave stacks another twelve weeks on top. Denied leave, pushed out early, or fired while pregnant? The review is free and confidential.
How Much Leave Do I Get? The Stacking Math
PDL, under Government Code 12945: up to 4 months, which is 17 and one third workweeks, per pregnancy, for any period you are disabled by pregnancy, childbirth, or a related condition. It applies at five employees, with no tenure or hours requirement. You are protected from your first day on the job.
CFRA stacks on top. Pregnancy disability is excluded from CFRA’s definition of your own serious health condition, so baby bonding leave is a separate twelve week bank. PDL plus CFRA reaches roughly seven months of job protected leave.
| Stage | Which law | How long |
|---|---|---|
| Prenatal disability, such as bed rest or severe morning sickness | PDL | Counts against the 4 month cap |
| Delivery and postpartum recovery | PDL | Counts against the 4 month cap |
| Baby bonding after recovery ends | CFRA | A separate 12 weeks |
Where the Money Comes From
State Disability Insurance covers the disability period and Paid Family Leave covers bonding, at roughly 70 to 90 percent of wages. Keep the two ideas separate: the money comes from the EDD, while the job protection comes from the statutes above.
Wage replacement percentages are refreshed each January 1.
What Conditions Qualify for PDL?
Severe morning sickness, prenatal appointments, ordered bed rest, gestational diabetes, preeclampsia, childbirth recovery, postpartum depression, loss of pregnancy, and recovery from related procedures.
PDL can be taken intermittently, in hours or days at a time, for appointments and flare ups. Your doctor decides the disability period, not HR.
Accommodation During Pregnancy, Before Any Leave Starts
Under Government Code section 12945(a)(3), you have the right to reasonable accommodation for pregnancy related conditions on your provider’s advice. A stool, water access, modified duties, schedule changes, or a transfer to a less strenuous position.
Refusing accommodation and pushing you onto leave early is its own violation. Forced leave is illegal. For the mechanics of the interactive process, see disability discrimination.
Evidence to Save
Doctor’s notes with restrictions, the accommodation request itself, HR’s responses, and the job description before and after.
Lactation Breaks Are the Law, Not a Favor
Labor Code sections 1030 through 1034 require break time each time you need to express milk, plus a lactation room that is not a bathroom. It must be close to your work area, shielded from view, free from intrusion, with a surface, a seat, and electricity, and with refrigerator and sink access nearby.
The penalty math matters here. Denial of time or space counts as a rest period violation, which is one additional hour of pay at your regular rate per day under Labor Code 226.7, and the Labor Commissioner, the state office that handles unpaid wage claims, can cite $100 per day of violation.
Deadlines. PDL and pregnancy discrimination both run through the Fair Employment and Housing Act (FEHA), the state’s main workplace discrimination law: 3 years to file with the California Civil Rights Department (formerly the DFEH), the state agency that handles discrimination complaints, then 1 year from the right to sue letter to file in court. Lactation break premiums follow wage claim deadlines, which are 3 years. See the full deadline table.
What to Do Right Now
- Get every restriction and disability period in writing from your provider.
- Submit leave and accommodation requests by email, not in conversation.
- Save the announcement email and every response after it.
- Photograph the lactation space you were given, or the closet they called one.
- Track the dates: announcement, request, denial, adverse action.
- Do not sign anything on the way out.
Frequently Asked Questions
Do I qualify if I just started my job?
Yes. PDL has no tenure requirement, unlike CFRA’s 12 months.
Is 4 months automatic?
No. The leave matches the disability period your doctor certifies, up to the four month cap.
Can I split PDL up?
Yes, intermittently, for appointments and complications.
What if my employer has fewer than 5 employees?
PDL will not apply, but your lactation and sick leave rights still do. It is worth a review anyway.
Can they make me start leave early?
No. Forced leave violates section 12945, and accommodation comes first.
Do I get paid during PDL?
Through SDI from the EDD, plus any accrued sick pay. Employer paid leave is not required.
My job changed while I was out. Is that legal?
PDL requires the same position. The exceptions are narrow and the employer bears the burden.
How does bonding leave work for fathers and partners?
CFRA bonding is separate from PDL and available to any new parent. See CFRA and FMLA violations.
