Wage and hour

California Meal and Rest Break Lawyers

A missed meal or rest break owes you one hour of pay, per day, per type. Most employees never claim it, and most employers count on that.

The Break Rules, Exact and Non-Negotiable

Meal Breaks, Labor Code 512

A 30-minute, unpaid, duty-free meal break starting before the end of the fifth hour of work. A second 30-minute meal is required before the end of the tenth hour.

Meal Waivers

The first meal is waivable by mutual consent only when the shift is 6 hours or less. The second is waivable only when the shift is 12 hours or less and the first was taken.

Rest Breaks

Ten paid minutes per 4 hours worked “or major fraction,” so shifts over 3.5 hours get one, over 6 get two, and over 10 get three, as close to the middle of each work period as practicable.

Duty-free means duty-free: off duty, off call, and free to leave. On-call rest breaks violate the law under Augustus v. ABM Security.

The employer’s duty is to provide the break and relinquish control, and it need not police it under Brinker. But pressure, understaffing, or a workload that prevents breaks is a violation.

The Premium: One Hour of Pay Per Day, Per Violation Type

Under Labor Code 226.7, you get one additional hour of pay at your regular rate of compensation for each workday a meal break is missed, late or short, plus one more hour for each workday any rest break is missed.

That is a maximum of two premium hours a day, one meal and one rest, no matter how many breaks of each type were denied that day.

“Regular rate of compensation” includes nondiscretionary bonuses and incentive pay under Ferra v. Loews, so employers who pay premiums at the base rate still owe the difference.

And because premiums are wages, unpaid premiums trigger waiting time and wage statement penalties under Naranjo v. Spectrum Security.

A Worked Example

$18 per hour, with the meal cut short and a rest break skipped every day. Two premium hours at $18 is $36 a day, $180 a week, $9,360 a year. Across the three-year lookback that is about $28,080, before stacked penalties.

Put Your Own Numbers In

The premium is one hour of pay per workday, per violation type. Enter your rate and a typical week to see what that comes to over the time it has been happening.

Before taxes. Use your base hourly pay.

One premium per day, so this cannot exceed the days you work.

Counted separately from meal breaks. Also capped at one per day.

How Employers Cheat the Break Rules

Auto-Deducting 30 Minutes

Whether or not you took lunch. Timekeeping records versus reality, plus coworker testimony, expose it.

Late Lunches

A meal that starts after hour five is a violation even when it is taken. Most employees have no idea.

Working Lunches

Eating at the desk, radio on, “stay close.” The duty-free standard makes on-call meals a violation.

Understaffing

A workload that makes breaks impossible under a policy that looks perfect on paper. Schedules, staffing ratios and production quotas are the evidence, and warehouse quota rules under AB 701 can add to it.

Coerced Waiver Forms

Subject to the waiver limits above, and waivers never apply to rest breaks.

What Is a Break Claim Worth?

Solo claims are meaningful. Class exposure is larger, and meal and rest violations drive many of California’s biggest wage class actions.

Deadlines

3 years for premium pay, 4 years under the UCL, and 1 year for PAGA penalties.

What to Do Right Now

  • Log your break times daily for two weeks: start time, length, interruptions.
  • Save schedules and timecards.
  • Note who told you to skip or cut breaks, and when.
  • Photograph the posted policies.

One thing worth knowing: your log helps every coworker too.

Frequently Asked Questions

Can I Skip Breaks to Leave Early?

Voluntarily skipping a break under a compliant policy is different from being pressured to skip it. The distinction turns on employer control.

I signed a meal waiver. Is my claim dead?

Not necessarily. Waivers are valid only within the shift-length limits above, and rest breaks cannot be waived at all.

Are Rest Breaks Paid?

Yes. They are on the clock.

My lunch starts at hour six. Is that legal?

No. It must begin before the end of hour five.

Do Smoke Breaks Count as My Rest Breaks?

Rest Breaks are a right, not a trade. The question is what the employer’s records show.

My whole crew misses breaks. Can we act together?

Yes, through a class or PAGA action. See class actions and PAGA.

Can My Boss Make Me Stay on Site During Lunch?

Generally no. The duty-free standard turns on employer control.
