Can I be fired for

Can I be fired for being pregnant in California?

Pregnancy is a protected trait under FEHA. This page covers your rights from the day you announce through the day you return.

The Short Answer

Pregnancy is a protected trait under California’s Fair Employment and Housing Act (FEHA), the state’s main workplace discrimination law, at employers with five or more employees. A firing motivated by pregnancy, leave, or a related condition is unlawful. And a firing dressed up as a “layoff” or “restructuring” gets tested on its evidence, not on its label.

Your Protection Timeline, Announcement to Return

It helps to see the protections as a sequence rather than a single rule, because each stage has its own failure point.

When You Announce

No demotion, hour cuts, or sudden “performance problems” tied to the news. Your timing evidence starts on this date, so write it down.

During Pregnancy

Reasonable accommodation for pregnancy related conditions, and no forced leave while you can still work.

During Leave

Pregnancy Disability Leave up to four months, plus CFRA bonding leave of twelve weeks at the five employee threshold, with job protection through each.

When You Return

Reinstatement to the same or a comparable position, lactation accommodation, and no quiet shelving into a lesser role.

Deadlines. FEHA claims run 3 years to file with the California Civil Rights Department, the state agency that handles discrimination complaints, then 1 year from the right to sue letter to file in court. Full deadline table

Two Separate Leaves, and They Stack

This is the single most misunderstood point on the subject, including by employers acting in good faith. California gives you two different leaves, and the second one starts where the first one ends rather than running alongside it.

Pregnancy Disability Leave

For the period you are actually disabled by pregnancy, childbirth, or a related condition. Up to four months. It does not require any minimum length of service, so it is available to someone who started the job recently. It can be taken in pieces rather than all at once, which matters for appointments, bed rest, and complications.

CFRA Bonding Leave

Separate leave, for bonding with the child, with its own eligibility rules rather than the same ones. It generally begins after the disability leave ends. The practical consequence is that the total time away can be longer than four months, and an employer who tells you four months is the ceiling may be running the federal rule by mistake.

If someone has told you that your leave is exhausted, that is a sentence worth checking rather than accepting, because the two leaves get collapsed into one more often than any other error in this area.

Accommodation While You Are Still Working

Leave is the last resort, not the first one. Before any of it, you are entitled to reasonable accommodation for pregnancy related conditions, and the point of accommodation is to keep you working.

  • Schedule changes, including later starts or shorter shifts.
  • More frequent breaks, and somewhere to sit.
  • Relief from heavy lifting, prolonged standing, or exposure to particular substances.
  • Transfer to a less strenuous or less hazardous position where one is available.
  • Time off for appointments.

There is a flip side that catches people out. An employer generally cannot push you onto leave while you are still able to do the job with an accommodation, even when the motive sounds protective. Being sent home for your own good, against your wishes, is a decision worth questioning rather than thanking someone for.

Pay and Benefits While You Are Out

The leave itself is job protection, not a paycheque. Wage replacement, if you get it, comes from a separate place.

California runs State Disability Insurance and Paid Family Leave through the Employment Development Department, funded by deductions already taken from your pay. They are claims you file with the state, not benefits your employer decides to grant, and an employer who says there is no paid leave here is answering a different question. Group health coverage continues during pregnancy disability leave on the same terms as before. Rules about using accrued sick leave or vacation during the unpaid stretch vary, so ask what the employer requires and what it merely permits.

Coming Back: Lactation Accommodation

The return is where a lot of otherwise careful employers stop paying attention. California requires reasonable break time to express milk, and a private space to do it in that is not a bathroom, located close to where you work, with somewhere to sit and a surface to put things on.

A cupboard, a car, a conference room that anyone can walk into, and a rota that makes the breaks impossible in practice are all versions of the same failure. If you are being told to use your own time or find your own space, write down what you were told and who told you.

What a Pretextual Layoff Looks Like

A genuine reduction in force can include someone who is pregnant or on leave. What a decision cannot do is use the restructuring as cover. The difference shows up in the evidence rather than in the label, and these are the questions that get asked.

  • How long was it between the announcement, or the leave request, and the decision?
  • Was anyone else cut, or was the reduction a reduction of one?
  • Was the role backfilled afterwards, or posted again under a different title?
  • Did the performance record change only after the news, and who wrote the new entries?
  • Has the stated reason stayed the same each time it was given?

What to Write Down, Starting the Day You Announce

Your timing evidence begins on the day you tell someone, which is why that date matters more than it looks.

  • The date you announced, who you told, and how.
  • Every accommodation request and the answer, in writing where possible.
  • Your leave paperwork, including what you submitted and when.
  • Performance reviews from before the announcement, saved now.
  • Any comment about your commitment, your plans, or your reliability after the news.
  • Copies kept somewhere that is not a company device or account.

Frequently Asked Questions

Can they fire me during maternity leave?

Leave is not immunity from a genuine reduction in force, but the burden of clean, neutral evidence sits with the employer.

I am on a small team of four.

FEHA counts five employees company wide, not team wide, and harassment protection reaches a single employee. Count everyone the company employs.

What about my health insurance during leave?

Group coverage continues during PDL on the same terms.

Do I have to tell my employer I am pregnant?

Not as a general matter. You will need to raise it to ask for an accommodation or to arrange leave, but there is no duty to announce on any particular schedule. Note the date when you do, because that is when your timing evidence starts.

My employer says they never received my leave paperwork.

This is common enough to plan around. Submit through a channel that leaves a record, keep your own copy, and follow up in writing so there is a trail showing what you sent and when. A lost form is a much weaker position for an employer when you can produce the sent item.

I was replaced while I was out. Is that automatically illegal?

Not automatically. Covering your work while you are away is normal and expected. The question is what happened when you came back, because the right is to return to the same or a comparable position, not to return to an organization that has quietly reshaped itself around your absence.

I had a miscarriage. Am I covered?

Pregnancy related conditions are covered, and that includes conditions arising from a pregnancy that does not continue. California also provides a separate reproductive loss leave, which is its own entitlement rather than part of the leaves described above. If you were disciplined, pressured to return, or treated differently afterwards, that is worth raising.
