How are you paid?

We derive an hourly rate from salary divided by 52 weeks divided by 40 hours.

Hours you worked each day

Enter a typical week. Decimals are fine, so 8.5 means eight and a half hours.

The seventh consecutive day carries its own rule: time and a half for the first eight hours, double time after that. We tick this for you when all seven days have hours.

Optional. Production bonuses, attendance bonuses, and commissions raise the rate your overtime is paid on.

What were you paid for hours past 8 in a day or 40 in a week?

When Does Overtime Start in California?

Daily after 8 hours and weekly after 40, both at time and a half. Double time after 12 hours in a day. Plus the seventh consecutive day rules, where the first 8 hours are time and a half and everything past 8 is double time.

Federal law only requires weekly overtime. That gap is the whole point of this page.

What Is My Regular Rate of Pay?

Your regular rate exceeds your hourly rate whenever you get nondiscretionary bonuses, commissions, or shift differentials. A $100 weekly bonus raises the rate every overtime hour is paid on. Employers who pay overtime on the base rate alone underpay every one of those hours.

I am salaried. Can I still get overtime?

Exemption requires the duties test and a salary of at least twice the state minimum wage for full-time work, which is $70,304 in 2026. Below that floor, the title on your badge is irrelevant. Read about misclassification.

What Can I Recover?

Unpaid overtime for 3 years, or 4 under the unfair competition law, plus interest and attorney fees and costs under Labor Code 1194. Wage-statement and waiting-time penalties stack when they apply. Waiting time penalty calculator.
