IS YOUR PAYCHECK PAST-DUE?

Waiting Time Penalty Calculator

If your final paycheck is late, the penalty is your daily wage times up to 30 days.

Estimate Your Waiting Time Penalty

Enter your pay and the two dates. Everything you type stays in your browser, and your former employer has no way to see that you used this.

How were you paid?

If you were regularly scheduled for overtime, include it. The daily wage uses your normal schedule.

We derive a daily wage from salary divided by 260 working days.

How did the job end?

Leave blank if you are still waiting.

A short final check that left out earned wages, accrued vacation, or commissions keeps the penalty running.

Payment has to include everything earned: wages, overtime, accrued vacation and PTO, and earned commissions and bonuses.

How the 30-Day Penalty Works

Daily wage times days late, capped at 30 calendar days. At $25 an hour on 8-hour days, the daily rate is $200, so 30 or more days late comes to $6,000, on top of the wages owed. The clock runs on calendar days. It does not pause for weekends, and it does not stop because you found a new job.

What If My Employer Paid Some of It?

A short check keeps the penalty accruing until you are paid in full. The common omissions are vacation payout, meal and rest premiums (break penalty calculator), final commissions, and expense reimbursements under Labor Code 2802. Accrued vacation and PTO are wages under Labor Code 227.3.

What Does Willful Mean Here?

Willful means intentional nonpayment, not malice. Forgetting, cash-flow trouble, and payroll processing delays do not defeat the penalty. A genuine good-faith dispute can.

How Do I Collect?

Through a Labor Commissioner wage claim or a lawsuit, within a 3-year window for the penalty under Labor Code 203(b). Attorney-fee exposure is what pressures employers to resolve these quickly.
