The LA Jobs Where Overtime Disappears

Production. 14 hour days, flat day rates that ignore daily overtime, misclassified assistants and coordinators, and meal penalty stacking on set.

Warehouse and last mile. Off the clock security screening, quota pressure that skips meal breaks with AB 701 hooks, and temp agency joint employer liability.

Garment. SB 62 requires hourly pay, piece rate is banned. Downtown Fashion District geography.

Healthcare and caregiving. Rounding software shaving minutes, per diem travel time, and live in caregiver rules.

Salaried managers. Fast food and retail managers doing crew work. The title does not decide the exemption.

Wage Claim Downtown, or Lawsuit at Stanley Mosk?

A DLSE wage claim at the downtown LA office, or a civil suit, with no exhaustion needed at the California Civil Rights Department (CRD), the state agency that handles discrimination complaints, for wage claims. For company wide practices, a class or PAGA action may fit using post reform numbers.

See class action and PAGA. Informacion en espanol.

Can My Employer Punish Me for Asking About Overtime?

No. Labor Code 98.6 protects wage complaints, with a 90 day rebuttable presumption under SB 497. See retaliation.

Los Angeles Unpaid Overtime FAQ

I get a flat day rate on set. Does daily overtime still apply?

Yes. A day rate has to satisfy daily overtime for hours past 8, and double time past 12.

My warehouse rounds my time to the quarter hour. Legal?

Not where actual time is captured and the rounding shorts you.

I am a salaried manager at an LA fast food franchise making $58,000. Exempt?

No. That is below the 2026 exempt floor of $70,304, so the overtime is still owed.

How Far Back Can I Claim Unpaid Overtime in California?

Three years, or four through a UCL claim.
